Acceptance of Terms

By accessing forgeaisystem.com and using The Forge's services, you agree to these terms. If you don't agree, don't use our site or services. We reserve the right to update these terms at any time. Updates are effective immediately upon posting.

Use License

We grant you a limited, non-exclusive, non-transferable license to access and use our website and services for your personal and business use. You may not:

• Copy, modify, or resell our content or services without permission
• Use our site for illegal or unauthorized purposes
• Attempt to gain unauthorized access to our systems
• Harass, threaten, or abuse our team
• Engage in competitive intelligence or reverse engineering

Intellectual Property

The Forge owns all content on this site: text, images, logos, design, and code. You may not reproduce, distribute, or transmit any of it without our written permission. This license grants you viewing rights only. No copyright is transferred to you.

User Responsibilities

When you use The Forge's services, you are responsible for:

• Providing accurate and complete information
• Maintaining the confidentiality of any login credentials
• Not using the service in ways that harm your business or ours
• Complying with all applicable laws and regulations

No Warranties

Our website and services are provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• Specific business results or revenue growth
• That defects will be corrected

We make our best effort to deliver quality work. But software and systems fail. We are not liable for downtime, data loss, or indirect damages.

Limitation of Liability

To the fullest extent allowed by law, The Forge is not liable for:

• Indirect or consequential damages (lost revenue, business interruption)
• Damages exceeding the amount you paid us for services
• Third-party claims or actions

This applies even if we've been warned of the possibility of such damages.

Payments and Refunds

Payment terms are specified in your service agreement or invoice. We accept major credit cards and process through Stripe. Refunds are at our discretion based on the services delivered and timeline. Digital deliverables and completed work are non-refundable unless we fail to deliver.

If you dispute a charge, contact us within 30 days at guruforge@agentmail.to.

Termination

You may stop using our services at any time. We may terminate your access if you violate these terms or engage in conduct we deem harmful. Upon termination, your right to use our services ends immediately. Provisions that should survive termination (liability, confidentiality, IP) will do so.

Confidentiality

Both parties may share confidential business information during our relationship. You agree to keep our proprietary methods, processes, and systems confidential. We agree to keep your business data and strategy confidential. This does not apply to information that is publicly available or was known before our relationship.

Indemnification

You agree to defend, indemnify, and hold harmless The Forge from any claims, damages, or costs (including legal fees) arising from:

• Your use of our services in violation of these terms
• Your violation of any law or third-party rights
• Content you provide to us

Dispute Resolution

If a dispute arises, we'll try to resolve it informally first. If that doesn't work, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA). Each party bears its own costs. Arbitration happens in Massachusetts unless we agree otherwise.

Governing Law

These terms are governed by the laws of Massachusetts, without regard to its conflict-of-law principles. You consent to the exclusive jurisdiction of the courts in Massachusetts.

Third-Party Links

Our site may contain links to third-party websites. We're not responsible for their content, accuracy, or practices. Use them at your own risk. We recommend reviewing their terms and privacy policies.

Severability

If any part of these terms is found to be unenforceable, that provision is removed and the rest of the terms remain in effect.

Entire Agreement

These terms, along with your service agreement, constitute the entire agreement between you and The Forge. They supersede all previous agreements, whether written or verbal.
